DISTANCE ELECTRONIC TICKET SALES AND PASSENGER TRANSPORTATION CONTRACT     

                           
ARTICLE 1- THE PARTIES:

ARTICLE 1.1- SELLER    :

Hereinafter referred to as the "SELLER".

 

ARTICLE 1.2- BUYER       :

The passenger transport ticket “https://backoffice.turkishsealines.com.tr ”the buyer from the website is the person named on the ticket in accordance with the information entered on this website and for whom the passenger transportation service will be provided. Hereinafter referred to as the ”buyer".

 

In the event that the credit card holder and the person who will receive the ticket service are separate persons, both the person who owns the credit card on which the ticket price is paid and the person who will receive the service are the receiving party of this agreement. According to this agreement, both persons declare and undertake that they will fulfill the rights and obligations arising from this agreement by gaining the title of buyer.

 

The buyer declares and undertakes that the accuracy of the information provided will comply with all the rules specified in this agreement during the service provided and will fulfill all the actions of this agreement.

 

ARTICLE 2- WEBSITE:

The address of the website where the seller sells the “passenger transportation ticket” under the provision of this agreement “https://backoffice.turkishsealines.com.tr ”dir.

Except for this website, all tickets reported to have been sold by the seller are invalid.

“https://backoffice.turkishsealines.com.tr " from now on, the business will be referred to as the “website” in this agreement.

 

ARTICLE 3- SUBJECT MATTER OF THE CONTRACT

The subject of this agreement is the SELLER's, https://backoffice.turkishsealines.com.re it is the determination of the procedures and principles related to the sale of passenger transportation tickets to the BUYER electronically via the website and the passenger transportation service provided to the BUYER. In this regard, the provisions of the Consumer Protection Law No. 4077 (the “Law”) and the Distance Contracts Regulation dated 27.11.2014 (the “Regulation”) have been taken into account.

 

ARTICLE 4- INFORMATION AND DELIVERY OF GOODS / PRODUCTS / SERVICES SUBJECT TO THE CONTRACT:

The services subject to this agreement are the sale of electronic tickets via the website on the transportation of passengers by ship and the provision of passenger transportation services to the buyer on whose behalf the electronic ticket is issued. The ticket consists of the seller's name, title, paid address, telephone, internet access information, MERSIS number, basic characteristics of the service subject to the contract, sales price, payment method, boarding place, destination, travel date, departure time, information on the seller's website at the time of termination of the order. The ticket is also sent to the recipient's e-mail address. As soon as the buyer terminates the ticket order specified in this agreement via the website, he/she shall be deemed to have RECEIVED the ticket subject to the contract. Together with the delivery, it is deemed to have accepted and committed that it will comply with the rules contained in the contract and perform its actions.

 

ARTICLE 5- COMMITMENT AND RESPONSIBILITY OF THE BUYER:

The buyer gives the necessary confirmation in electronic environment that he has read and has information about the basic characteristics of the passenger transportation ticket subject to this agreement, the passenger transportation rules, the sale price and paying method, as well as all the information related to delivery. The buyer agrees and undertakes that he has read this agreement and the passenger transportation rules as soon as he receives the ticket, that he will comply with all the rules contained in the agreement, and that he will perform all his actions.

 

The buyer agrees and undertakes that if the business does not comply with the rules set out in this agreement and does not perform its actions in accordance with the rules set out in the agreement, the seller may terminate this agreement immediately without any notice, without reserving all rights.

All damages of the buyer arising from the buyer's failure to comply with this business agreement belong to the buyer himself.

 

Tickets purchased in accordance with this agreement are only at the disposal of the person named on the ticket and can be used in person. The buyer accepts and undertakes the accuracy of the information entered on the website and that he has purchased a ticket for use by the person named on the ticket. If it is determined that the person mentioned on the ticket and the person who wants to receive the service are different, the buyer accepts and undertakes that the seller has no responsibility arising from this agreement and can terminate this agreement without any notice.

 

ARTICLE 6- RIGHT OF WITHDRAWAL

Due to the fact that the articles of the Regulation written under the heading “Section Three” regulating the “Use of the Right of Withdrawal and the Obligations of the Parties” are not applied to “Passenger Transportation Services”, the BUYER does not have the right of withdrawal.

 

ARTICLE 7- F/B Turkish Sealines REFUND & CANCELLATION CONDITIONS AND GENERAL RULES

1) CHECK-IN 

The passenger must be present at our Ulusoy Port Office to complete the check-in procedures no later than 1 hour before the departure time so that passport, visa checks can be performed and tickets can be delivered. The check-in process ends half an hour before the departure time. It is recommended to come earlier on weekends and during high season.

Check-in transactions can be made at all our offices before the departure day.

15 Min from the passenger departure time. he has to be present at the ferry first.

Our passengers are obliged to adjust the time spent in the Cafeteria or Freeshop within the Port area according to these rules.

2) OPEN TICKETS: The purchase of open tickets for a scheduled flight can only be made at the convenience of the expedition and is carried out only by Turkish Sealines offices. In order to close the open tickets, a Turkish Sealines office should be contacted no later than 1 day before the departure and the passenger should be informed about this before the trip.

The validity period of the open ticket is 6 months. An unused ticket is automatically canceled 6 months after the ticket's cut-off date.
Suspended tickets, the agent who issued the ticket must sign and stamp the suspension date and declare it on the boarding.
3) TICKET LOSS SITUATION: The passenger who lost his ticket has to buy a new ticket. The agents are not responsible for ticket losses for any reason. The tickets found should be immediately forwarded to the Turkish Sealines Head Office at Beyazit caddesi No. 6-7 Cesme/Izmir.

4) NON-TRANSFERABILITY OF THE TICKET: The passenger ticket issued in the name cannot be transferred and cannot be resold to someone else. If a ticket is presented for carriage and refund by a person other than the person entitled to travel on a ticket, the carrier shall not be liable to the person entitled to travel on that ticket if he carries the bona fide submitter or returns the ticket to the submitter.

5)TICKET CANCELLATION AND REFUND REQUESTS

Due to the fact that it is not applied to ”Passenger Transportation Services"; The BUYER does not have the right of withdrawal.

Jale Tourism Passengers have the right to suspend and re-date their tickets 1 time or re-date them 1 time provided that they notify them 2 days before the departure time. Refund requests will not be accepted.

6) CASES WHERE THE PASSENGER IS NOT ALLOWED TO EXIT ABROAD OR ENTER GREECE

Judicial, administrative, visa or vehicle that the passenger who does not originate from Jale Tourism wants to take with him, pet, etc. in cases of interference with entry/exit caused by, the service agreement expires and any refund request will not be accepted.

7) CANCELLATION / CHANGE OF THE EXPEDITION

Passengers are obliged to register their mobile numbers in the system. Thus, passengers may be informed of the cancellation or change of the flight.
In flights that cannot be carried out due to weather opposition, an unconditional 100% refund is made to the passenger. The SELLER is not responsible for accommodation, food and beverage expenses that may arise in weather conditions, strikes, lockouts and similar situations caused by reasons that are not in the SELLER's hands.
In cases of unscheduled Flag state controls, Unplanned ship malfunctions, the SELLER's rights to change the time of the voyage and the ship are reserved.
All rights of the SELLER regarding the cancellation and modification of the expedition are reserved.
8) TICKET CONTROL: Ticket controls are carried out with the help of barcodes on the boarding boards on the ship cover. Passengers with tickets that have been canceled, changed or suspended for any reason will not be taken on board.

9) PASSENGERS WITH SPECIAL REQUESTS / PASSENGERS TRAVELING WITH PETS

Agents should inform Jale Tour Offices about passengers with special circumstances no later than 2 hours before departure.
The necessary documents for passengers traveling with pets should be requested from Jale Tour Offices and delivered to Turkish Sealines bodrum office 2 days before the trip. The passenger's trip cannot be confirmed without approval from the Chios Veterinary Presidency.
10) The passenger must present the credit card used for the purchase to the authorities at the time of check-in (at the port when the boarding pass is received).

 

11) - The passenger agrees to comply with the on-board regulations and the captain's instructions.

 

12 - All kinds of disputes related to transportation are resolved in Çeşme Courts in accordance with the tariff terms and Turkish Laws and Regulations.

 

13 - Ladies whose pregnancy period has passed six months are not allowed to travel on our ships for their own safety.
